FANIME™ Terms of Service

By creating an account, accessing, or using FANIME™ (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Fanime LLC (“Fanime,” “we,” “us,” or “our”).

1. Acceptance of Terms

Use of the Service indicates acceptance of these Terms.

2. Eligibility and Age Requirements

FANIME™ is intended for users 13+. Users under 13 are not permitted. If you are under 18, you may use FANIME™ only with consent/supervision of a parent/guardian who agrees to these Terms on your behalf.

Fanime does not collect exact age/DOB and relies on user representations, reports, and observed behavior. Fanime may take immediate action if we reasonably believe age was misrepresented or behavior poses safety risk to minors.

3. User Accounts and Security

You are responsible for safeguarding your credentials and all activity under your account. Notify Fanime immediately of unauthorized use. Fanime may suspend/restrict/terminate accounts that violate Terms or pose risk.

4. User Content and License

You retain ownership of your content. By submitting content, you grant Fanime a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, use, reproduce, display, and distribute content solely for operating, improving, moderating, and promoting the Service.

You are responsible for your content and represent you have rights to post it and it does not violate laws, third-party rights, or these Terms.

5. Prohibited Conduct

• Harassment/Abuse: Unwanted contact, intimidation, coercion, unsafe behavior
• Conduct Involving Minors: Any sexualized/romantic/flirtatious/exploitative behavior involving minors, including continuing contact after being asked to stop
• Sexually Explicit or Harmful Content: Pornography, grooming, sexual exploitation, extreme violence
• Off-Platform Solicitation: Attempts to move conversations off FANIME™, especially involving minors
• Fraud/Spam/Impersonation: Deception, misrepresentation, impersonation
• Platform Interference: Hacking, disruption, reverse engineering, manipulation

Violations may result in removal, restriction, suspension, or termination. Fanime may act without notice to protect safety or integrity.

6. Safety, Blocking, and Reporting

FANIME™ provides blocking and reporting tools. Blocking prevents interaction and does not affect our ability to investigate. Report concerns via in-app tools or email safety@fanimeapp.com.

7. Copyright Policy (DMCA Compliance)

Fanime complies with the DMCA. Send notices to fanimeapp@gmail.com including required details (contact info, copyrighted work, location of allegedly infringing content, good-faith statement, penalty-of-perjury accuracy statement). Repeat violations may lead to termination.

8. Beta Version Notice

FANIME™ may offer beta features that may change or be discontinued. The Service is provided “as is” and “as available,” without warranties. Beta may contain bugs or incomplete functionality.

9. Termination and Enforcement

Fanime may suspend/restrict/terminate access at its discretion for violations or risk. Termination may result in loss of access to data/features. Fanime may preserve data for safety/legal compliance.

10. Limitation of Liability

To the fullest extent permitted by law, FANIME™ is provided “as is” and “as available.” Fanime disclaims warranties. Fanime is not liable for indirect/incidental/special/consequential/punitive damages.

Fanime’s total liability will not exceed $100 USD or the amount paid by you in the prior 12 months, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Fanime LLC and affiliates from claims arising out of your use, content, or violations.

12. Dispute Resolution and Arbitration

Disputes will be resolved through binding arbitration administered by JAMS under its Comprehensive Arbitration Rules, in Hennepin County, Minnesota unless otherwise agreed. Claims are individual only; class actions are waived.

You may opt out within 30 days by emailing fanimeapp@gmail.com with subject “Arbitration Opt-Out.”

13. Governing Law

These Terms are governed by Minnesota law and applicable U.S. federal law.

14. Changes to These Terms

Fanime may update Terms periodically. Material changes will be communicated via in-app notice or email. Continued use after updates constitutes acceptance.
